Arival LLC is committed to protecting your privacy. This Privacy Notice (“Notice”) explains how Arival, our subsidiaries and affiliates (collectively, “Arival,” “we,” “our” or “us”) collect, use and share your Personal Information when you access any website, mobile app or software application (the “Sites”) administered by us or engage with us in business activities. This Notice applies to private data (“Personal Information”) collected and processed in connection with your use of the Sites or when you interact with us in other communication channels such as by phone or email. 

Personal Information means any data relating to an identified or identifiable individual, also referred to as a living person, or data subject.

Processing means doing anything with your Personal Information: actions such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.

This Notice applies to our Site visitors, current or prospective clients and their employees or contract workers, our colleagues, job applicants, contingent or contract workers, vendor or partner employees or contractors, or others that engage with us in business activities.  

The applicability of certain details of this Notice may vary depending on your relationship with us, where you reside or are covered under applicable data protection legislation or regulation in different jurisdictions (“Data Protection Law”), and, if applicable, the services Arival or a partner provides to you. Arival processes Personal Information necessary for us to carry out our business and is committed to protecting the privacy of all individuals with whom it deals according to Data Protection Law.

Arival is committed to transparency of how we observe and apply data protection principles.

  • When we process Personal Information, we make sure such processing is according to Data Protection Law. We may collect Personal Information that you voluntarily provide to us and where associated with any account created to use our services. We may process non-personal information about how you use our website or interact with our services and use it to help us improve our services.   • We maintain safeguards to protect Personal Information. How does Arival collect your personal information?

We collect Personal Information about you when you interact with us, including when you visit and use the Sites. We also collect Personal Information about you that you voluntarily provide to us or otherwise publicly available sources. Arival may automatically collect information about the devices you use to interact with the Sites. 

Data Protection Law distinguishes between “controllers” and “processors” of Personal Information. While other jurisdictions and laws use similar terminology, such as “exporter” and “importer,” the concept remains the same. Arival may be a controller (meaning, the entity deciding the purpose and means of Personal Information processing) or a processor (meaning, the entity that processes Personal Information on behalf of a controller), depending on the nature of the relationship with a company, institution or agency, and/or individuals. Arival may engage with another controller (either independently or jointly determining the purpose and means of Personal Information processing).

What type of information does Arival collect?

Depending on the Sites you visit or interact, or the services Arival provides to you, we may collect information from you or about you including, but not limited to, the information listed below. We may provide this information to our service providers, business partners, or third parties as required by law or as part of our service delivery offering to you.

  • Identifiers, such as
    • your name, alias, avatar, photo,
    • contact details (business, professional or personal) email address, (business, professional or personal) phone number or mobile number, (business, professional or personal) postal address,
    • your IP address or other unique online identifiers,
    • username, password, account details and history, membership program details,
    • purchase details and history, account payment-related financial details, such as credit card or bank account information. Such information may be entered directly in a partner’s or payment-processing provider’s site.
    • information relating to sponsorship (e.g., where event speakers are also sponsors, or where a sponsor is presenting in an event demonstration session),
    • information relating to compliments or complaints (feedback), or
    • and any other information you voluntarily provide, such as dietary restrictions when providing information for an event.
  • Internet or other Electronic Network Activity Information when you access our Sites, we may automatically collect information about your devices, including, but not limited to,
    • IP address, device type, device make and model, browser type, browsing history, search history, web page that referred you to our site,
    • geolocation data, but not your precise geolocation. We collect geographic location information provided by a device interacting with the Sites or associated with your IP address or other online or device identifier, or
    • information regarding your interaction with our Sites, such as navigation journeys.

We may collect this information through the lawful use and deployment of cookies and other online tracking technologies as set forth in the Cookie Notice on the Site you visit.

  • User Profiles.  Arival may aggregate the information that we collect about you or that you disclose in order to provide you with information on the Sites, deliver and enhance the services we provide to you, and secure our Sites against unlawful activity. We do not share or sell the user profiles that we create with third parties. We may provide this information to our service providers, business partners, or third parties as required by law or as part of our service delivery offering to you.
  • Biometric Information.   Arival does not collect or process Biometric Information for the purpose of unique identification of an individual, except where biometrics may be used for security purposes, such as optional fingerprint or facial recognition processing for account authentication, authorization, or identification, or where such processing is mandatory for activities that require enhanced security measures.
  • Audio, electronic, visual, thermal, olfactory, or similar information.  Arival may collect voiceprints and other audio files of your voice, visual recordings such as in a webinar recording, CCTV when you are on our premises (commercial or home offices) or a picture on an ID entry card. 
  • Information Subject to Protected Classifications under Data Protection Law (also known as Sensitive Information or Special Category Data)
    • Arival does not process Sensitive Personal Information, except where required by applicable law, or that you disclose to us, for employment or legal purposes.

When you choose to provide information to Arival, such as in a contact form, we may ask you to provide us with Personal Information to fulfill your request. You may choose not to provide Personal Information to us by refraining from, among other things, using portions of the Sites that require Personal Information. You also may refrain from submitting other Personal Information directly to us that we do not request of you. However, if you do not provide Personal Information when requested, we may not be able to provide you with the full range of our products and services, or with information about our products and services, promotions, and other opportunities. Where you receive our services through a partner, we recommend that you contact that partner directly about the processing of your Personal Information.

Information for working with us

For our colleagues, contingent workers and job applicants, we may collect information from or about you, as required by law or as you disclose to us, listed in the below categories including, but not limited to, the following:

    • personnel ID, candidate reference ID, date of hire, employment status, performance records, leave information, and date of termination,
    • employment history including previous employers and job titles and/or positions, background information (such as your academical and professional qualifications, education, details included in your CV/resume, which might include details of memberships or interests constituting sensitive personal information, employment references,
    • driver’s license number, passport number, national identification number or other similar identifiers,
    • financial information (such as bank account number or salary), insurance details, or other benefits-related identifiers, pay history, tax withholding information,
    • details about your immigration or visa status, criminal offence information, or other background-check identifiers required or allowed by law,
    • Arival may collect and process Sensitive Personal Information only where required by applicable law, or that you disclose to us, for employment or legal purposes, such as life, health, financial details, physical characteristics and description, race, gender, marital status, sexual orientation, professional liability and workers compensation insurance programs, employee benefit program participation and coverage information, membership of a trade organization or union, or veteran/military status. We do not use or disclose your sensitive personal information for any purpose other than as permitted by applicable law.

We may provide this information to our service providers, business partners, or third parties as required by law or as part of our service delivery offering to you.

Where we collect and process Sensitive Information (as described above), and where applicable, we rely on one of the exceptions listed in Article 9 (2) of the European Union’s (EU) and United Kingdom’s (UK) General Data Protection Regulation (“GDPR”), to permit that sensitive information processing, including the affected person’s explicit consent.

Otherwise, we process your Personal Information as necessary for the performance of a contract, in compliance with our legal obligations or any other identified legitimate interest.  

We use your information to manage all parts of the applicant administration process including evaluating resumes, interviewing, selecting and hiring (or contracting) personnel, and conducting background check investigations. 

In certain circumstances, and to comply with applicable laws and regulations, we may need to collect, or request, Sensitive Personal Information for legitimate recruitment-related purposes: for example, information about your race or ethnic origin, gender and disabilities for the purposes of equal opportunities monitoring, to comply with anti-discrimination laws and for government reporting obligations; or information about your physical or mental condition to consider accommodations for the recruitment process and/or subsequent job role. For the most part, the provision of this information will be entirely voluntary, however, where the processing of this information is required, we will make this clear at the relevant time you may provide, on a voluntary basis, other Sensitive Personal Information during the recruitment process.

If you are accepted for a role or position at Arival, the information collected during the recruitment process will form part of your ongoing employee record and will be processed according to our Privacy Policy and other applicable policies.

We will not use your information for automated individual decision-making as contemplated under Article 22 of the GDPR and as described in other Data Protection law.

How does Arival use (process) your personal information?

We may use the Personal Information we collect, within our processing or that of our authorized sub-processors, for the following business purposes:

  • To provide information or services requested by you or on behalf of your employer, under contract as our client or partner;
  • To send you communications according to services provided;
  • To provide you with information about our products and services according to your marketing and contact preferences (which may include emails, calls and messages);
  • To respond to customer-service inquiries;
  • To implement third-party services for us or on behalf of your employer;
  • To conduct processing necessary to fulfill other contractual obligations that affect you;
  • To manage our everyday business needs and operations, such as internal service and operations, administering and improving the Sites and our services;
  • Undertake troubleshooting and detect malfunctions within the Sites and services we provide as well as improving user-experience;
  • To enable you to search our job postings, submit your resume, and contact or be contacted about your submission.
  • To prevent unlawful conduct, enforce our Terms of Use, comply with applicable laws and Arival’s reporting obligations (including sharing information, where applicable, with statutory authorities, government institutions, law enforcement agencies and other official bodies), securing our Sites and your account and enforcing our agreements;

If you are an Arival employee (full- or part-time) or a contingent or contract worker (full- or part-time equivalent), we may use your information to support personnel administration and management including maintaining and processing records necessary to manage the employment or worker relationship. 

What are the legal (lawful) bases for processing your personal information?

Your information will be processed by us according to Arival’s policies, or as required by contract with you or your employer. We will process Personal Information only when we have a legal (lawful) basis to do so. The legal basis we rely on will be one of the following:

  • The processing is necessary for Arival to perform activities under contract with you or your employer, or fulfill a direct request that you have made that applies to the contract;
  • The processing is necessary for purposes that are in Arival’s legitimate interests, such as protecting the security of the Sites, conducting research to improve our products and services, improving the functioning of the Sites, providing you promotional materials about products in which you have expressed an interest.
  • You have consented to the processing of your Personal Information, for example, when you applied to a job posting or agreed to receive marketing material; or
  • The processing is necessary for Arival to comply with a legal obligation.

In order to process Sensitive Personal Information as defined in Data Protection Law, we rely on contractual or explicit consent legal bases that we or your employer obtain from you in order to provide you with services or fulfill a specified request.

If we intend to use Personal Information for a purpose other than the purpose for which we collected the data, we will provide you with information about this secondary purpose, the legal basis for processing and, where required, obtain your explicit consent, before we engage in further processing.

When and to whom does Arival disclose your personal information?

Your information may be disclosed for a variety of business purposes:

  • With your consent or at your direction: We may disclose your Personal Information if you tell us or ask us to do so.
  • With your employer: As part of the services we provide, we may disclose your Personal Information to your employer if that organization is a client of Arival. Certain enquiries or requests may be responded directly by your employer instead of Arival.
  • With our service providers: We may disclose your personal information to our service providers and contractors who perform services on our behalf but only if (a) your Personal Information is necessary for them to carry out such services and (b) those service providers and contractors are required to use any Personal Information they receive according to Arival’s instructions and pursuant to a data processing agreement that complies with the requirements of Data Protection Law.
  • With our business partners: We may provide your information to our business partners with whom we work to provide you with products and services or to perform one or more of the business purposes identified above. For example, this may include your employer, a third business partner of your employer, or our business partner under contract. We may also provide your information to other business partners as directed by you. 
  • To enforce our Terms of Service and other agreements between you and Arival, including for billing or collection purposes.
  • In the event of corporate change or internal audits: We may disclose a business relationship but never the Personal Information or customer data uploaded to the service, in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company. If necessary and legally required, we will obtain your separate explicit consent in this regard. Disclosure may also be required for Arival audits.
  • To comply with legal requirements: We will disclose your information (i) if we are required to do so by law or legal process, (ii) in response to lawful law enforcement authority or other official government requests, (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, (iv) in connection with an investigation of suspected or actual illegal activity including any legal proceedings or prospective legal proceedings in order to establish, exercise or defend our or a third party’s legal rights or (v) as required for Arival audits or to investigate a complaint or security threat, privacy violation or any other breach of Arival internal policies. 
  • To companies within our corporate family: We may disclose your personal information to our corporate affiliates organizational purposes based on a legitimate interest. To the extent that our corporate affiliates have access to your personal information, they will follow practices that are at least as restrictive as the practices described in this Privacy Notice, will use your information solely for the purpose for which it was provided, and will not further disclose your information.

We do not sell any personal information to third parties and have not done so for the past 12 months.

Does Arival transfer personal information to other countries?

We may process Personal Information in countries in which we do business and whose Data Protection Law may differ from the jurisdiction in which you live.

  • When we transfer Personal Information of those who are located in the EU or EEA, or UK to a location outside of the European Economic Area, or UK, respectively, for processing, we use an approved transfer mechanism such as the EU approved Standard Contractual Clauses (SCC), and/or UK International Data Transfer Annex or the Addendum to the EU SCC (Annex), in our contracts or Data Protection Agreements.

How does Arival protect your personal information?

Arival has implemented physical, technical, and administrative security safeguards, designed to protect personal information from loss, misuse, alteration, exfiltration, or destruction; considering the sensitivity of the information and the purpose for which it was collected. However, no method of data storage or transmission is completely secure. You are responsible for maintaining the security of your account ID, password and other forms of authentication involved in accessing password-protected or secured Sites.

Arival’s technical and organizational security measures include maintaining an Information Security Management System (ISMS), a Personal Information Management System (PIMS), and a compliance program.

Important measures include:

  • privacy and security by design, including privacy engineering and secure systems development,
  • personal data collection limitation, data minimization, and disclosure limitation,
  • technical measures and processes to ensure personal data accuracy and quality
  • data masking techniques, such as pseudonymization and encryption, 
  • ensuring limited data retention,
  • protection of data during transmission and storage 
  • user identification, authentication and authorization,
  • technical measures and processes to ensure the security of the processing,
  • ensuring ongoing resilience of processing systems and services,
  • ensuring the ability to restore in the event of a physical or technical incident,
  • ensuring physical security of locations at which personal data are processed,
  • ensuring secure configuration of electronic systems,
  • information security and privacy governance and management,
  • handling and responding to data subject rights’ requests, and
  • measures we contract with our vendors (as sub-processors).

Our Sites may contain links to other sites that are outside of our control and are not covered by this Notice. If you access other sites using the links provided, the operators of those sites may collect information from you which will be used by them according to their own privacy policies and notices. We encourage you to read the privacy policies and notices for other websites you visit. Arival is not responsible for the content or privacy practices of linked sites or any use of those sites.

How long does Arival retain personal information?

Unless provided otherwise in this Notice, we will retain your information for as long as your account is active or for as long as necessary for the relevant purposes of processing. We may also retain and use your information for longer periods in case it is necessary to comply with our legal obligations, resolve disputes, and/or enforce our agreements. To the extent possible, Arival will de-identify, or take reasonable steps to delete from its records, information no longer required for the purposes identified in this Notice, other than information which we are required by law to retain.

What are your Rights?

Depending on the nature of relationship with Arival, where you reside or are covered under applicable Data Protection Law, and, if applicable, the services Arival or a partner provides to you, we provide you the ability to exercise your rights regarding our collection and processing, including use, storage, and sharing of your information. Please note that for some of these rights, we will need to verify your identity before we are able to respond to your request, including using commercially reasonable efforts to confirm your identity including matching the information provided in your request with the information we have on file about you. Depending on the sensitivity of the information involved in your request, we may also apply more stringent verification methods to protect against unlawful conduct and ensure your request is fulfilled in a transparent and secure manner.

Right to Access and Data Portability: The right to access and data portability applies differently depending on where you reside. Arival provides this right regardless of where you reside.

  • If you are a resident of the EU, European Economic Area (EEA) or UK or as stated in other Data Protection Law, you have the right to obtain confirmation as to whether your Personal Information is being processed, and if so, the right to access your Personal Information. If we maintain your Personal Information, you can also request that we provide you a copy of your data in a structured, commonly used, and machine­ readable format and request the transfer of certain of your Personal Information to another party under certain conditions.
  • If you are a California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, or Nevada resident
You have an additional right to know the categories and specific pieces of Personal Information we have collected about you, including a description of the categories of sources from which we have collected that information, the business or commercial purpose for collecting or sharing that information, and the categories of third parties with whom we have shared that information. You may also designate an authorized agent to submit a request on your behalf by submitting proof of written authorization along with your request.

Right to Correction or Rectification: Regardless of where you reside, you have a right to correct or amend the information we have about you.

Right to Non-Discrimination: We will not discriminate against individuals for exercising any of their data rights under Data Protection Law.   This means that if you exercise any of your rights in connection with your Personal Information, we will not deny you goods or services, charge different prices for them, or provide different levels of service for them.

Right to Deletion or Erasure: The right to delete or erase Personal Information also applies differently depending on where you reside or Data Protection Law.

  • If you are a resident of the EU, EEA or UK, or as stated in other Data Protection Law, where the conditions are met provided by and subject to Data Protection Law, you may request that we erase your Personal Information.
  • If you are a California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, or Nevada resident, you have a right to ask that we delete your information subject to appropriate exceptions. You may also designate an authorized agent to submit a request on your behalf by submitting proof of written authorization along with your request.

Right to Object to Processing: If you live in the EU, EEA, or UK, or as stated in other Data Protection Law, you may object to the processing of your personal information in certain circumstances when we (i) process your information for the purposes of our legitimate interests, (ii) use your personal information for direct marketing; or (iii) use your personal information for statistical purposes.

Right to Restrict Processing: If you are a resident of the EU, EEA, or UK or as stated in other Data Protection Law, you have the right to request restriction of your Personal Information under certain circumstances.

Right to Withdraw Consent: If you are a resident of the EU, EEA, or UK or as stated in other Data Protection Law, and when our legal basis for processing your information is your consent, you may withdraw your consent at any time. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

California Notice of Sale

We do not sell the personal information of California residents, nor have we sold California resident personal information in the past 12 months. We have no actual knowledge of selling the personal information of minors under the age of 16.

Notice to Residents of Connecticut, Colorado, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Nevada, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia

We do not sell any personal information we collect to any third parties.  If we were to do so in the future, we will update this Privacy Notice (Statement), and provide residents with the opportunity to opt-out of the sale of their personal information.

Complaints: If you have concerns about the way in which we have handled your information, please contact us (see Contact Us below) so that we can try to resolve the issue.

  • If you are a resident of the EU or EEA, you also have the right to submit a complaint with the supervisory authority applicable in the jurisdiction in which you are located, and with relevant judicial authorities. Contact details can be found at https://www.edpb.europa.eu/about-edpb/about-edpb/members_en.
  • If you are a resident of the UK, you may complain to the Information Commissioner’s Office (ICO). Contact details can be found at https://www.ico.org.uk. Complaints can be submitted at https://www.ico.org.uk/make-a-complaint.

You can access, correct, update, and request deletion of your Personal Information using your online account, emailing us, contacting our call center, or by directing your query to your employer that contracted with us. We (or your employer, where applicable) will respond to your request within 30 days or sooner subject to Data Protection Law. We may need to verify your identity before we fulfill your request.

In some circumstances, only your employer, and not Arival, may have the authority to update, correct, or delete your personal information. In these instances, please contact your employer directly. Otherwise, we will forward your request to your employer.

Notice to Residents of California

If you are a California resident, California Data protection Law provides you with certain rights as described in California Privacy Rights Act (CPRA), which amended the California Consumers Privacy Act (CCPA).

California permits you to opt out of the disclosure of your Personal Information by Arival to third parties for those third parties’ direct marketing purposes. We do not disclose your personal information to third parties for the third parties’ direct marketing purposes unless you affirmatively agree to it. You may opt-out of this disclosure by submitting your request to [EMAIL or DSAR TOOL]. We may need to verify your identity before we fulfill your request.

Notice to Residents of Colorado, Iowa, New Hampshire, Tennessee, or Utah

If you are a resident of Colorado, Iowa, New Hampshire, Tennessee, or Utah their respective Data Protection Law contains certain consumer rights, including the rights of resident consumers to opt out of the Sale of Personal Data and the Processing of Personal Data for Targeted Advertising.

These States permits you to opt out of the disclosure of your Personal Information by Arival to third parties under a Sale of Personal Data or Targeted Advertising purposes. We do not disclose your personal information to third parties these purposes unless you affirmatively agree to it. You may opt-out of this disclosure by submitting your request to [EMAIL or DSAR TOOL], or, for Colorado, by one of Colorado’s specified Universal Opt-Out Mechanisms (UOOM). We may need to verify your identity before we fulfill your request.

Notice to Residents of Connecticut, Delaware, Indiana, Kentucky, Maryland, Minnesota, Montana, New Jersey, Nebraska, Oregon, Rhode Island, Texas, or Virginia

If you request electronic communications, such as an e-newsletter or marketing material, you will be able to unsubscribe at any time by following the instructions included at the bottom of the email or message communication.  However, you cannot opt-out of emails or messages we are required to send as part of our ongoing relationship with you.

Visitor Visa​
Overview

Generally, a citizen of a foreign country who wishes to enter the United States must first obtain a visa, either a nonimmigrant visa for a temporary stay, or an immigrant visa for permanent residence. Visitor visas are nonimmigrant visas for persons who want to enter the United States temporarily for business (visa category B-1), for tourism (visa category B-2), or for a combination of both purposes (B-1/B-2).

Here are some examples of activities permitted with a visitor visa:

    • Attend a scientific, educational, professional, or business convention or conference

How to Apply

There are several steps to apply for a visa. The order of these steps and how you complete them may vary by U.S. Embassy or Consulate. Please consult the instructions on the U.S. Embassy or Consulate website.

Complete the Online Visa Application

  • Online Nonimmigrant Visa Application, Form DS-160 – Learn more about completing the DS-160. You must: 1) complete the online visa application and 2) print the application form confirmation page to bring to your interview.
  • Photo – You will upload your photo while completing the online Form DS-160. Your photo must be in the format explained in the Photograph Requirements.

Schedule an Interview

Interviews are generally required for visa applicants with certain limited exceptions below. Consular officers may require an interview of any visa applicant.

These are the terms and conditions (the “Agreement”) governing Your participation in any Arival owned and/or operated event, meeting, show, seminar, or conference, whether held as a live, virtual, or hybrid (both live and virtual) event (the “Event”). By registering for the event, You agree to these terms, which form a binding legal contract between the Event owner and host, Arival, LLC (“Arival” or “Owner” or “Organizer”) and the registered attendee (“You,” “Your” or “Attendee”). If You are registering on behalf of another individual, it is Your responsibility to ensure the person participating is aware of these terms and accepts them. By completing the registration on behalf of another individual, You are warranting that You have made the Attendee aware of these terms and that they have accepted these terms.

ATTENDEE PROVISIONS

Access. Your registration entitles You to access the Event for which You have registered. Any and all other costs associated with Your attendance shall be borne solely by You, and the Event shall have no liability for such costs.

Event Content. You acknowledge and agree that the Event, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to the Event name, themes, content, program, speakers, performers, hosts, moderators, venue, and time. Some Event content may be recorded by Arival and made accessible to paid Attendees.

FEES AND REGISTRATION

Payment. The payment of the applicable fee for the Event is due upon registration. If such payment is insufficient or declined for any reason, Arival may refuse to allow You to access the Event and shall have no liability in that regard.

Event pricing varies based on company type. You are responsible for registering using Your applicable company type.

Taxes. The fees may be subject to sales tax, and value-added tax, or other taxes and duties, which, if applicable, will be clearly stated and charged to You in addition to the fees.

Electronic Communications. Once You have completed Your registration, You will receive Your registration confirmation by email. Please ensure that Your valid email is entered correctly on the registration form. Be sure to check Your junk email box, too, if any of Your Virtual Event email(s) are caught by spam filters. Arival shall not be liable for mis-entered email addresses or other data.

If You do not receive Your registration confirmation and fail to notify us by email at least 24 hours prior to the event, Arival shall not be liable if you cannot view the event live.

You will receive essential Event information for registered attendees electronically at the email address provided on Your registration form.

In addition, You will also be subscribed as an Arival Insiders Free Access member if You are not already a member, which includes notifications of future events as well as the Arival newsletter and other communications. If You would like to opt-out of any of these benefits, a link is provided in each email to provide the ability to opt out.

CANCELLATION, CHANGE AND REFUND POLICY

All cancellations must be submitted in writing to [email protected]. Cancellations outside of 60 days shall be refunded in full without an administrative fee. Cancellations received inside 60 days of the published event start date are subject to loss of all monies paid with no credit for future events. Registration fee refund coverage may be offered.  Name change requests and ticket transfers are subject to a 100.00 change fee. The currency of refunds and fees will be the same as the currency in which tickets are sold.

Virtual Events. Please note that you are still responsible for payment if You do not cancel and do not access the Virtual Event. In no event shall Arival be obligated to refund all or a portion of the registration fee.

Health & Safety Protocols. Arival is committed to producing a successful, productive, and, above all, safe Event for all Attendees, Arival staff, and hotel staff. We establish on-site preparedness plans and health & safety protocols to allow each attendee to feel as safe as possible and reduce the possibility of COVID transmission. Final protocols will be determined by 60 days prior to the event and will be based on recommendations from national, local and other health authorities.

By registering for the event, you confirm that You will abide by the safety measures that Arival puts into place. Failure to abide by the safety measures may result in the cancellation of Your registration with no refund.

Policies for attendance at the Event will be subject to change as conditions change regarding Covid-19. A final determination of policies will be made no later than 70 days prior to the event start date. This provides You with one week to cancel Your registration if You are not willing or able to comply with the Event policies. Arival reserves the right to set the safety measures at its sole discretion.

An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the CDC, senior citizens and guests with underlying medical conditions are especially vulnerable.

BY ATTENDING ARIVAL, YOU VOLUNTARILY ASSUME ALL RISKS AND AGREE TO HOLD HARMLESS, RELEASE AND INDEMNIFY ARIVAL, ARIVAL’S VENDORS, AND SUPPLIERS FOR ANY AND ALL LIABILITY RELATED TO EXPOSURE TO COVID-19 INCLUDING SERIOUS HEALTH AILMENTS AND DEATH.

CONDUCT OF ARIVAL ATTENDEES

Each Attendee agrees that during Arival, he/she shall conduct themselves professionally and courteously at all times with respect to Arival staff, sponsors, and Attendees. If an Attendee fails to comply with these expectations or behaves in a rude or unacceptable manner, Arival reserves the right to terminate the Attendee’s continued attendance at the Arival Event and will revoke their credentials. The Attendee agrees to return the credentials to an Arival representative upon request and will lose all fees paid to Arival. Expenses resulting from this revocation of Arival credentials are the sole responsibility of the Attendee. See our full Code of Conduct here.

LIMITATIONS ON USE

By registering for an Arival Event ticket, you agree not to sell, trade, transfer, or share your access link and/or code unless the Organizer grants such transfer. If Arival determines that You have violated this policy, Arival may cancel Your access, retain any payments made by You, and ban You from future Events, in addition to any other actions deemed appropriate.

RECORDING, LIVE STREAMING AND VIDEOTAPING

Attendees may not record or broadcast audio or video of sessions at Arival Events.

UNETHICAL/NON-COMPLIANT BUSINESS PRACTICES

Arival reserves the right to deny participation to anyone who engages in or is reputed to engage in unethical or non-compliant business practices

ARIVAL SPONSORSHIP AND OTHER FUNCTIONS/EVENTS

The undersigned hereby acknowledges that Arival provides various companies with the opportunity to sponsor and host a variety of functions and social events during Arival (herein “Sponsored Event”) and that these sponsors pay an additional fee to host these events. To provide the sponsors with the maximum opportunity to host a successful Sponsored Event, Arival will not permit functions, social events, or gatherings of ten or more attendees to take place during the Arival event that would detract from the attendance of Arival attendees at any/all Sponsored Events. Exceptions for special circumstances may be granted if they have been previously requested in writing and approved by an authorized Arival representative. Therefore, the undersigned agrees not to organize, sponsor, or operate any function, social event, or gathering of ten or more attendees, either directly or indirectly, during Arival. If any individual, company, or entity breaches this agreement, the undersigned acknowledges that Arival shall have the right, to terminate the participation of that attendee, as well as any of its/their associates, representatives, and/or employees participating at Arival.

PRIVACY POLICY AND PERSONALLY IDENTIFIABLE INFORMATION (“PII”)

Your decision to register for an Arival event indicates your understanding of and agreement with our Privacy Policy.

Attendee acknowledges that Arival provides our sponsors with the PII of our Attendees/Attendees and hereby provides consent to have their PII included in the list provided to sponsors. The data provided will be used by sponsor companies for the sole purpose of marketing the products and services of the sponsor companies and will not be sold, traded, or otherwise given to any other company or person. All sponsor companies provided with PII have warrantied that they are GDPR compliant.

FORCE MAJEURE

Should acts of God, acts of war or terrorism, pandemic, strikes, lockouts, labor disputes, inability to obtain labor or material, governmental restrictions or regulations, judicial order or other casualty or cause, not within the control of Arival make it impractical or impossible for the Arival Event to be held, Arival shall have the right, without obligation, to select an alternate date and venue for in-person events, and in such case Attendee agrees to participate per the terms and conditions herein.

If Arival is prevented from carrying out its obligations as it pertains to the Event for which You registered as a result of any cause beyond its control, or such Event cannot be conducted Live or Virtually due to any cause, not within the control of the Organizer, (collectively a “Force Majeure”) Arival shall have the right to immediately terminate the affected Event without liability and shall be relieved of its obligations to Registrant. If an affected Virtual Event is terminated due to a Force Majeure occurrence before the first day of the Virtual Event, then Arival will make every effort to reschedule the affected Virtual Event, and Your registration fee will be applied to the rescheduled Virtual Event. In such case, as the Virtual Event cannot be rescheduled within 60 days as a result of any Force Majeure event, Arival shall have the right to immediately and permanently terminate the affected Virtual Event without liability and shall be relieved of its obligations to Registrant.

For purposes hereof, the phrase “cause not within the control of the Organizer” shall include failures of a software or issue with the hosting or other required platform in the case of virtual events, or in the case of all events both virtual and in-person shall include fire, casualty, flood, epidemic, earthquake, explosion or accident, blockage, embargo, inclement weather, governmental restraints, restraints or orders of civil defense or military authorities, act of public enemy, riot or civil disturbance or commotion, malicious damage, sabotage, vandalism, acts of terrorism, or other similar activities, strike, lockout, boycott or other labor dispute or disturbance, inability to secure sufficient labor, technical or other personnel, absence of premises required for the Exhibition, failure, impairment or lack of adequate transportation facilities, inability to obtain or requisition or commandeering of necessary supplies or equipment, change in local, state or other law, ordinance, rule, order, decree or regulation, whether legislative, executive or judicial, and whether constitutional, or act of God and the words “act(s) of” shall include “threat of or perceived threat of”.

A Force Majeure event specifically includes the following:

  • If a local, county, state or national governmental authority issues any order or recommendation: (i) for individuals in the local government area of the scheduled Event to limit their time away from their residence or property (except for essential activities, functions, and businesses); (ii) for persons arriving at any airport from any one or more major cities or metropolitan areas (population greater than 500,000) to isolate or self-quarantine for any period of time (even if subject to certain exceptions) when the total of originating cities represents 5% or greater of total event attendance; (iii) to restrict public gatherings in enclosed spaces to less than 400 people in the scheduled local government area.
INTELLECTUAL PROPERTY

All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event are owned by Arival or the Event sponsors or speakers presenting at the event. You may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at the Event, in any Event content, or in any materials distributed at or in connection with the Event for any reason without the prior written permission of Arival.

For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by Arival or any of its affiliates; nor does this Agreement grant to You any right or license to any other intellectual property rights of Arival or its affiliates, all of which shall at all times remain the exclusive property of Arival and its affiliates.

MEDIA RELEASE

You as Attendee hereby authorizes Arival to use, reproduce, and/or publish photographs and/or video that may pertain to the Attendee —including image, likeness, and/or voice without compensation. The Attendee understands that this material may be used in various publications, public affairs releases, recruitment materials, broadcast public service advertising (PSAs), or other related endeavors. This material may also appear on the Arival website, web blogs, social media pages, and posts. This authorization is continuous, and Arival may publish materials, use the Attendee’s name, photograph, and/or make reference to the undersigned in any manner that Arival deems appropriate in order to promote/publicize Arival events. The Attendee hereby releases Arival, its partners, employees, contractors and agents, the photographer/videographer, and any other associated vendors from any and all claims or liabilities.

Use of Likeness. By participating in the Event, You acknowledge and agree to grant the Event the right at the Event to record, film, live stream, photograph, or capture Your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from You or any payment to You. This grant to the Event includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.

WAIVER OF LIABILITY

Attendee and each of its agents, employees, and representatives, hereby waive and release any claim of any type or nature whatsoever against Arival and each of its agents, partners, employees, representatives, successors, and assigns, arising out of or relating to his/her/its participation in Arival or attendance at Arival, including, but not limited to personal injury, damage to personal property, theft, etc. Furthermore, Attendee for itself and each of its agents, employees, and representatives, hereby agree to indemnify and hold harmless Arival and each of its agents, partners, employees, representatives, successors, and assigns from any claim, demand, lawsuit, or dispute of every type or nature whatsoever (including their reasonable attorney’s fees and costs incurred), arising out of or relating to his/her participation in Arival or attendance at Arival.

LEGAL

This contract shall be governed by the laws of the State of Colorado. The prevailing party in any arbitration or litigation concerning the terms and conditions of this proposal shall be entitled to reasonable attorney’s fees and costs.

Disclaimer of Warranties, Limitation of Liability

Arival gives no warranties in respect of any aspect of the Event or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. The Event is provided on an “as-is” basis. The views, opinions, and positions expressed by the speakers, attendees, or sponsors at the Event are theirs alone and do not necessarily reflect the views, opinions, or positions of Arival or any employee thereof. Arival makes no representations as to accuracy, completeness, timeliness, suitability, or validity of any information presented by speakers, attendees, or sponsors at an Arival Event and will not be liable for any errors, omissions, or delays in this information or any losses, injuries, or damages arising from its display or use. Arival does not endorse and expressly disclaims all liability relating to any of the products or services provided by speakers, attendees, or sponsors.

Except as required by law, neither Arival nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages, or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with this Agreement.

The maximum aggregate liability of Event for any claim in any way connected with, or arising from, the Event or this Agreement, whether in contract, tort, or otherwise (including any negligent act or omission), shall be limited to the amount paid by you to Arival under this Agreement.

Miscellaneous

Arival’s failure to exercise any right provided for herein shall not be deemed a waiver of any further rights hereunder. Arival shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Arival’s reasonable control. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. This Agreement is not assignable, transferable, or sub-licensable by you except with Arival’s prior written consent. This Agreement shall be governed by the laws of the State of Colorado, and the parties shall submit to the exclusive jurisdiction of the Colorado courts. A party that substantially prevails in action brought under this Agreement is entitled to recover from the other party its reasonable attorneys’ fees and costs. Both parties agree that this Agreement is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications, and other understandings relating to the subject matter of this Agreement and that all modifications must be in writing signed by both parties, except as otherwise provided herein. No agency, partnership, joint venture, or employment is created as a result of this Agreement, and you acknowledge that you do not have any authority of any kind to bind Arival in any respect whatsoever. a

Arival reserves the right to refuse entry to or remove any party from any event or community space at any time when participation or behavior create a disruption or hinder the event or enjoyment of the event by other participants. All determinations are at the sole discretion of Arival, and the decision of the Arival team will be final. Severe breaches of this Conference Code of Conduct may result in disqualification from participating in future events. Individuals expelled due to violating this Conference Code of Conduct will not be eligible for a refund or other consolation.
